datai marketplace terms and AI footage license
Version: non-exclusive-ai-training-v1 · 3 November 2026
1. The marketplace
datai lets contributors publish offers and submit video recordings for review, and lets buyers license approved footage. Two modes are available: an individual contributor collection, and a category batch assembled from offers whose contributors have opted into batches. Creating an account or uploading a recording does not guarantee acceptance, a sale or earnings.
2. Contributor permissions
You retain ownership of your original recording. By submitting it, you authorize datai to store, review and prepare it for the marketplace. Once approved and included in an order, you authorize datai to license that order’s recording snapshot to the buyer under this license.
You must have the rights to record and license the content, including the necessary permissions for the location, workplace, people, objects and confidential information involved. Do not upload unlawful material, unsafe tasks, private documents, unauthorized workplace footage or recordings of people who have not agreed. Provide accurate descriptions, durations and annotations. Platform review does not relieve you of these obligations.
3. Buyer license
A confirmed paid order grants a non-exclusive right to use its listed footage and annotations for AI model training, evaluation, research and model development, including commercial model development. This license does not transfer ownership of the original footage.
You may not resell or redistribute the original files as a dataset, publish the raw footage, use it to identify or re-identify participants, or use it for prohibited surveillance or unlawful purposes. Sharing raw recordings with another organization requires a separate authorization. Models developed using licensed footage are distinct from redistribution of the raw files.
4. The order snapshot
Your order records the videos, reviewed durations, metadata, annotations, price and license version included at the time it is prepared. Footage added later is not silently added to that order. Already licensed recordings are excluded from repeat purchases by the same buyer where the order remains paid. Download access is granted after payment confirmation and depends on the order’s valid status.
5. Pricing and proportional allocation
Direct collections use the contributor’s displayed direct hourly rate. Category batches use the displayed category rate; the current configuration is €1 per approved hour. Contributors can choose whether each offer participates in category batches.
The current platform commission is 0%, and payment processing fees are absorbed by datai under that configuration. A batch’s contributor pool is allocated in proportion to each contributor’s licensed duration. Rounding uses whole cents and a deterministic remainder method, so the allocations add up to the pool. For example, a €1,000 pool covering 300, 500 and 200 hours allocates €300, €500 and €200.
These examples do not represent available inventory or guaranteed earnings. The live catalogue reports approved inventory. Very small orders can fall below the payment provider’s minimum; the platform does not silently increase their price.
6. Payments and payouts
Checkout and payout onboarding are provided by Stripe when enabled. Payment confirmation is verified on the server. A return to the site after checkout is not proof of payment. Draft orders record pending contributor allocations. These are not earnings or payouts; they become eligible for transfer only after confirmed payment and eligible payout onboarding.
A contributor must complete eligible payout onboarding before funds can be transferred to their connected account. Allocated, pending, transferred and reversed amounts are distinct states. Payout timing depends on provider eligibility, identity checks, available funds and banking schedules. Refunds and disputes can reverse or withhold the corresponding allocations. Applicable mandatory rights remain unaffected.
7. Quality, annotations and removal
Automatically accepted footage has passed the platform’s versioned machine checks: measured media, complete analysis coverage, structured action labels, visual-quality checks and model privacy flags. Machine labels remain approximate and are not human-verified. Contributor declarations establish the submitted permissions; a model does not verify legal rights from pixels. Exceptional manual review may be used when needed. Specialist layers such as segmentation, object tracking, depth or calibrated pose are included only if explicitly specified. Human footage does not by itself contain robot actuator commands or measured robot states.
You can pause an offer to stop new sales from that offer. Existing valid licenses and transaction snapshots are handled separately. For privacy, rights concerns, refund requests or a disputed recording, contact datai promptly. Do not assume that removing an offer cancels a license already granted.
8. Accounts, privacy and support
Keep your password and recovery code private. Use the marketplace only with the authority and permissions required for your actions. The privacy notice describes how account, recording and transaction information is handled.
For support or a request concerning a recording or order, contact contact@modelmentor.fr. These terms describe the implemented marketplace and license version; a separately agreed project specification may add requirements for a specific dataset.
